We know that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This Privacy Policy describes what information Calvert McBride Inc. collects from you through your use of and access to our websites, mobile sites, applications, and other services (collectively, “Services”) and how we use, share, and protect your information.  
We encourage you to read this Privacy Policy in its entirety before using our Services to make sure you fully understand our practices. By accessing or using our Services, you acknowledge that you have read and agree to this Privacy Policy.

1. Applicability.
This Privacy Policy applies to all users of our Services (collectively, “User”, “you”, or “your”).   To provide you with our Services, we collect or may collect personal information relating to an identified or identifiable natural person (“Personal Information”). This Privacy Policy describes how we handle Personal Information. 
Please keep in mind that this Privacy Policy does not apply to Personal Information collected by any third party. Personal Information collected by a third party is subject to the third party’s own privacy policies.  We have no control over and are not responsible for the privacy practices of third parties.

2. How we collect your Personal Information. 
We collect information in order to provide our Services to you, to improve your experience, and to communicate with you about our Services and for other business purposes.  We collect information that you provide to us, such as when you register for an account, fill out a form, upload content, purchase a product or service, or communicate with us.  We may automatically collect other information when you use our Services, as described below.  We may also acquire information indirectly from third parties and other sources.

    2.1 Personal Information you give us.
When you use our Services, we collect information that you provide us, such as when you register for an account, fill out a form, upload content, purchase a product or service, or communicate with us.  This includes or may include your first and last name, company name, address, e-mail address, telephone number, fax number, and password.
If you place an order or request a service, we may collect information that you provide to us such as your shipping, billing, and payment information.  Payment information may also be processed through a third party.  In that case, the third party’s privacy policy will apply.
Some of our Services allow you to upload and share images, photos, logos, videos, drawings, or similar content (“Content”) in order to communicate with us or to request products and services. The Content you choose to upload may include Personal Information about you. When you upload your Content or give us permission to access the Content stored on your device, your Content may also include related image information such as the time and the place your photo was taken, tags and similar information stored by your image capture device.
If you contact our customer service team or communicate with us by other means, we may also collect information from you from these communications, either in relation to feedback you give us or help you ask for in relation to the use of our products and services. 
We may also ask you to write a review to share your experiences with others. When you write a review, we may collect the information you provide, along with the name you display. Please note that reviews are public, so only include information you are comfortable with sharing publicly.

    2.2 Personal Information we may collect automatically.
Whenever you use our Services, we may automatically collect certain information through your device or browser. This information may include your IP address and information about your computer's hardware and software. We may also collect location information from your IP address. We may collect some of this information by using cookies or other similar technologies directly from your device. 
We may also automatically collect and store certain information about your activities while using our Services, such as the date, time, and pages you visit, and how you use our Services and access its contents.  We do not track your activities across other websites, mobile sites, or applications.

    2.3 Personal Information we may receive from other sources.
Calvert McBride Inc. may also obtain information about you that is publicly available or from other sources, such as independent third parties and business partners. Any information we get from these sources is combined with Personal Information you provide to us for the purposes described in this Privacy Policy.

3. Children.
Our Services are not targeted to or meant for use by children under the age of sixteen years old, and children under that age are prohibited from creating an account or otherwise providing their Personal Information. If we become aware that a child under the age of sixteen has provided Personal Information through our Services, we will remove their Personal Information from our files. If a parent or guardian becomes aware that their child has provided such information through our Services, the parent or guardian should contact us so that we may respond appropriately.

We process Personal Information for the following legal bases:
Performance of contract: where the collection and processing of your Personal Information is necessary to perform a contract or to take steps to enter into a contract with you.
Compliance with legal obligation: where it is necessary to comply with a relevant legal or regulatory obligation that we have.
Our legitimate business interests: in furtherance of our legitimate business interests including: to maintain, enhance and improve our Services, user experience, and business operations; to correspond with you, notify you of events or changes to our Services, or otherwise respond to your queries and requests for information; for data analysis and reporting; to protect and defend our legal rights and interests and those of third parties.

6. How we disclose and share your Personal Information. 
Calvert McBride Inc. does not sell your Personal Information.  However, we may share your Personal Information in the following situations:
We may provide your Personal Information to third party service providers to assist us with: fulfilling or delivering your order; storing and securing data; processing payments; website and platform operations; marketing, analytics, and fraud detection activities; customer service.  These service providers are only allowed to use your information in connection with the specific service they provide on our behalf.
We may also share your Personal Information where you direct us as part of the Services we are providing to share your Personal Information with a third party service provider in order to integrate our services with a service that they may provide.
We may also share your Personal Information as required or permitted by law or to protect our rights or property or those of others. We may also be required to respond to requests from law enforcement agencies, but only if those agencies meet the standards for obtaining Personal Information consistent with local laws and data protection requirements. Finally, we may provide some or all of your Personal Information to one or more third parties in the event of a merger, acquisition, sale of assets, bankruptcy, insolvency event, corporate reorganization or similar event involving us.
While your privacy is very important to us, due to the existing legal and technical environment, we cannot ensure that your Personal Information will not be disclosed to third parties in ways not described in this Privacy Policy. For example, third parties may unlawfully intercept or access transmissions or private communications. While we will stipulate that any third parties to whom we are entitled to divulge your Personal Information will respect this Privacy Policy, in any event, we cannot and do not guarantee that all such entities will, in fact, follow the terms of this Privacy Policy.

Subject to the applicable law and dependent on certain conditions, you may have the following rights: access your Personal Information and obtain copy of the Personal Information we hold about you; correct or update inaccurate or incomplete Personal Information; request that we delete your Personal Information; object to the processing of your Personal Information; restrict the processing of your Personal Information; withdraw your consent where processing is based on a consent you have previously provided.  Please know that some of the Personal Information we retain is necessary for us to respond to your inquiries, fulfil your orders, and provide you with other business-related services.  
You may exercise your rights by contacting us directly or by lodging a complaint with a local supervisory authority.  We may ask you to verify your identity before taking further action on your request.

8. How can you exercise these rights?
You may contact our customer service team to exercise any of the rights listed above.
Generally, Calvert McBride Inc. does not send out marketing emails.  However, should you receive a marketing email from us, you can change your marketing preferences at any time by either clicking the "unsubscribe" link at the bottom of any marketing email or by contacting the customer service team as provided for in the Contact Us section below.  Even if you change your preferences, we may still communicate with you regarding your orders, your account or for other administrative purposes (such as communications related to a pending order, an unresolved customer service issue, or a policy update).

9. How long do we keep your Personal Information and how do we protect it?
We only retain your Personal Information for the length of time needed to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law (for example, records of transactions or shipments).
Calvert McBride Inc. has implemented administrative safeguards and security measures that are designed to protect against unauthorized access, disclosure, use and modification of Personal Information. These measures include but are not limited to encryption methods, access controls, controlled administration of user rights, and limiting the access to the Personal Information to those who have a business need for such access. We regularly review our security procedures to consider appropriate new technology and methods.
Please recognize that protecting your Personal Information is also your responsibility. When you establish a Calvert McBride Inc. account, you should select a strong password and keep it safe by not sharing it with others. If you have reason to believe that the security of your account might have been compromised, or if you suspect someone else is using your account, please let us know immediately.
In compliance with Fair Information Practices, should a data breach occur, we will notify you by posting a notice on our website within 7 business days of discovering the breach.  We will also notify you by email within 7 business days of discovering the breach.  We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.

10. What are Cookies?
Cookies are small data files which often include a unique identifier that are stored on your device when you use certain Services. Cookies are useful because they allow a website to recognize a user's device.

11. How can you manage which Cookies are placed on your device?
The Help menu on the menu bar of most browsers will tell you how to enable or prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie and how to disable cookies altogether. 12. Compliance with CAN-SPAM Act.
The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
We collect your email address in order to: send information, respond to inquiries, and/or other requests or questions; process orders and to send information and updates pertaining to orders; we may also send you additional information related to your product and/or service; we may  market to our mailing list or continue to send emails to our clients after the original transaction has occurred.
To be accordance with CAN-SPAM we agree to the following: we will not use false, or misleading subjects or email addresses; we will clearly identify any messages which contain advertisements; we will include the physical address of our business in messages; we will monitor third party email marketing services for compliance, if one is used; we will honor opt-out/unsubscribe requests quickly; we will allow users to unsubscribe from marketing emails, if any.

13.  State specific rights. 
Depending on the state in which you live, such as California, Virginia, Colorado, Connecticut, Utah or Nevada, you may have additional rights with respect to your Personal Information. These rights may include the right to: request additional disclosures about the Personal Information we collect, use, and disclose; obtain a copy of Personal Information; request deletion of Personal Information; request the correction of Personal Information; request to opt out of the “sale” or “sharing” of Personal Information for purposes of online behavioral advertising or other website tracking; and limit the use or disclosure of sensitive personal information. We will not discriminate against you for exercising any of these rights, for example, by charging a different price or denying goods or services. 
You, or an authorized agent (where applicable), can exercise these rights with respect to one or more of our services and to the extent applicable to you under the respective US State Laws. In order to exercise your rights, we may have to verify your identity. We will do this by asking you to provide us with certain information we already have to confirm your identity. This can include your contact information, account number, or purchase history details. Authorized agents, where applicable, will be required to provide proof of their authorization and we may also require that you directly verify their identity and the authority of the authorized agent.  We will review your requests and respond accordingly. The rights described herein are not absolute and we reserve all our rights available to us at law in this regard. 

    13.1  Special Disclosures for California Residents
California Consumer Privacy Act
The California Consumer Privacy Act (“CCPA”) is applicable to our collection of personal information from California residents.  The CCPA requires businesses to give notice of the categories of Personal Information collected and how that Personal Information is used.  This information is disclosed in the section titled “How we collect your Personal Information,” and “How we use your Personal Information.”  You can find more information about the CCPA here: https://oag.ca.gov/privacy/ccpa. 
California Shine the Light
If you are a California resident, you have the right to request information about how we share certain categories of Personal Information with third parties. California law gives you the right to send us a request at a designated address to receive the following information: categories of information we disclose to third parties for their direct marketing purposes during the preceding calendar year; names and addresses of the third parties that received that information; and, if the nature of the third party's business cannot be determined from their name, examples of the products or services marketed.  You may send your requests to the email address provided in the Contact Us section.  

    13.2  Special Disclosures for Virginia, Colorado, Connecticut and Utah Residents
Unless specifically stated, we do not sell Personal Information to third parties, nor do we process your Personal Information for the purpose of profiling in furtherance of decisions that produce legal or similarly significant effects. 
13.3  Special Disclosures for Nevada Residents
Nevada law gives Nevada residents the right to request that a company not sell their Personal Information for monetary consideration to certain other parties.  The right to opt out of the sale of your Personal Information applies even if your Personal Information is not currently being sold.  If you are a Nevada resident and wish to exercise this right, please contact us.
